These Terms of Service govern access to and use of VPS, Cloud VPS, hosting, domains, SSL certificates, servers, network resources, and related Internet infrastructure services supplied by FUNOM. By creating an account, placing an order, paying an invoice, or using a service, you confirm that you have read and accepted these Terms.

1. Services and Contract Documents
FUNOM supplies digital infrastructure services, including virtual servers, cloud resources, web hosting, domains, SSL certificates, backup options, licenses, and related technical services. Each product may have its own specifications, location, billing cycle, resource limits, setup requirements, and service description shown during ordering or in the customer area. The order, invoice, product description, applicable policies, and these Terms form the agreement between the customer and FUNOM.
FUNOM may improve or replace infrastructure, upstream providers, networks, software versions, and operational processes where reasonably necessary for security, reliability, compliance, or compatibility. We will provide reasonable notice when a planned change materially affects an active service, unless urgent security or legal action is required.
2. Eligibility and Account Registration
You must have legal capacity to enter this agreement and must provide accurate, current, and complete registration and billing information. Business users confirm that the individual accepting these Terms has authority to act for that business. FUNOM may require identity, address, payment ownership, or intended-use verification before or after activation.
You are responsible for safeguarding passwords, API credentials, recovery methods, and administrator access. Activity performed through your account is treated as authorized unless you notify FUNOM promptly of compromise. You may not sell, transfer, or share an account in a manner that bypasses verification, sanctions, fraud prevention, or product restrictions.
3. Orders and Provisioning
An order is a request for service and may be reviewed for availability, technical compatibility, payment, or fraud risk. Payment alone does not guarantee acceptance where a product is unavailable, an order is unlawful, information is false, or the transaction presents unacceptable risk. Provisioning times are estimates unless FUNOM expressly agrees otherwise.
Customers must verify selected operating systems, locations, resources, billing cycles, domain spelling, and add-ons before payment. Once a custom digital resource such as a VPS, IP address, domain, or certificate has been allocated, cancellation and refund rights may be restricted as described in the Refund Policy.
4. Prices, Invoices, and Payment
Prices, currency, taxes, setup fees, and billing cycles are displayed in the order or invoice. Services are generally prepaid. You authorize FUNOM and its payment providers to process amounts you approve and to use transaction information for reconciliation and fraud prevention. Bank, exchange, intermediary, or payment-provider charges remain the customer's responsibility unless stated otherwise.
Invoices must be paid in full by the due date. Account credit is an internal payment balance and is not cash or a bank deposit. FUNOM may correct obvious pricing, calculation, or configuration errors before provisioning and will provide the option to accept the corrected order or receive an appropriate reversal where required.
5. Renewals and Expiration
Recurring services renew only after the corresponding WHMCS invoice has been paid or an authorized automatic payment succeeds. FUNOM may issue renewal invoices before the due date. It is your responsibility to maintain current contact and payment information and to review renewal notices.
Late or unpaid services may be suspended, restricted, or terminated. Data may be permanently deleted after the applicable retention or grace period. Domain, certificate, license, and upstream-provider renewal deadlines may differ from VPS or hosting deadlines, and restoration may require additional fees or may be impossible. Customers must maintain independent backups and must not rely on an expired service as storage.
6. Customer Responsibilities
You are responsible for all content, applications, users, configurations, licenses, traffic, and activity associated with your services. You must maintain appropriate backups, apply security updates, control administrative access, protect credentials, monitor usage, and respond promptly to abuse or security notices. Managed support is provided only when expressly included in the purchased product.
You must comply with applicable laws, intellectual-property rights, privacy obligations, registry and registrar rules, software licenses, network policies, and reasonable technical instructions. You must not use a service in a way that degrades shared infrastructure or creates material risk to FUNOM, an upstream provider, or another user.
7. FUNOM Responsibilities
FUNOM will use commercially reasonable efforts to provision and operate the purchased service, maintain administrative and billing systems, protect customer account information, communicate significant incidents, and provide support through the published channels. Availability commitments or service credits apply only where a specific service-level agreement expressly provides them.
FUNOM is not responsible for managing customer software, websites, code, data, firewalls, DNS zones, mail reputation, or backups unless the relevant managed service explicitly includes that work.
8. Acceptable Use Policy
You may not use FUNOM services for unlawful, fraudulent, abusive, or harmful activity. Prohibited conduct includes unsolicited bulk messaging or spam; phishing; credential theft; malware, ransomware, spyware, botnets, or command-and-control systems; denial-of-service attacks; unauthorized port scanning or vulnerability exploitation; intrusion into systems you do not own or lack permission to test; distribution of illegal material; infringement of copyright, trademarks, privacy, or other rights; and attempts to conceal or facilitate criminal activity.
You may not bypass resource limits, interfere with monitoring or billing, forge network identifiers, operate open proxies for abuse, resell services without permission where permission is required, or use excessive shared resources in a manner that harms other customers. Security testing is allowed only on assets you are legally authorized to test and must not affect FUNOM or upstream networks.
9. Abuse Reports and Investigations
FUNOM may investigate abuse reports, automated alerts, payment disputes, or security events and may require information or remediation from the customer. We may preserve relevant logs and cooperate with upstream providers or lawful authorities where required. Failure to respond within a reasonable or stated period may result in restrictions or suspension.
10. Suspension and Termination
FUNOM may suspend or restrict a service immediately where necessary to address attacks, malware, spam, fraud, non-payment, legal demands, infrastructure risk, or a serious violation of these Terms. Where practical, we will identify the reason and remediation steps. Restoration depends on full remediation, payment of outstanding amounts, and confirmation that risk has been addressed.
You may request cancellation through the customer area. Cancellation stops future renewal but does not automatically create a refund right. FUNOM may terminate accounts for serious or repeated violations, false information, chargeback abuse, or refusal to cooperate with a security or compliance review.
11. Data, Backups, and Intellectual Property
You retain rights in lawful content you upload and grant FUNOM the limited technical permission necessary to host, transmit, back up, and process that content to provide the service. You confirm that you have all required rights and licenses. FUNOM may remove or restrict content in response to a valid complaint, court order, legal obligation, or policy violation.
Unless a purchased service expressly guarantees managed backups, backups are provided on a best-effort operational basis only and do not replace customer-controlled copies. You must export all required data before cancellation, expiration, or termination.
12. Disclaimers
Services are provided on an as-available basis according to the purchased specification. FUNOM does not guarantee uninterrupted operation where performance depends on the public Internet, customer software, upstream providers, data centers, third-party licenses, maintenance, attacks, or events outside reasonable control. We do not warrant that a service is suitable for a particular regulated or high-risk purpose unless expressly agreed in writing.
13. Limitation of Liability
To the maximum extent permitted by law, FUNOM is not liable for indirect, incidental, special, consequential, or punitive loss, including lost profits, lost business opportunities, reputation damage, or data loss caused by the customer's failure to maintain adequate backups. FUNOM's aggregate liability for a claim relating to a service will not exceed the fees paid for the affected service during its most recent billing period, except where applicable law does not permit that limitation.
14. Force Majeure and Changes
Neither party is liable for delay or failure caused by events beyond reasonable control, including natural disasters, war, government action, widespread telecommunications failure, major cyberattack, labor disruption, or upstream infrastructure failure. FUNOM may update these Terms to reflect legal, security, operational, or product changes. The current version will be published on this page, with additional notice for material changes where appropriate.
15. Governing Law and Contact
These Terms are governed by the applicable laws of Vietnam, without limiting any mandatory consumer rights that cannot lawfully be excluded. The parties should first attempt to resolve disputes through good-faith communication. Questions, legal notices, and support requests may be submitted through the official FUNOM contact page or an authenticated customer support ticket.
